An introduction for Supervisors and Managers to Security of Payments legislation, and how it affects every job, project, and customer relationship

 

Key topics covered:

The course will explain the principles of payment obligations in the civil construction industry. It will provide insights for supervisors into how their actions on a day to day basis managing staff, projects and contract impact on the ability of their business to be paid promptly, including claims for variations and changes. 

 Topics include:

  • Fundamentals of how a civil business invoices and receives cash – the importance of cashflow
  • Fundamentals of the SOP law across Australia, and other laws affecting payment 
  • Obligations on head contractors and sub-contractors/suppliers
  • Importance of reporting and adherence to contract terms
  • The impact of variations on cash – and how they are applied in SOPA
  • Mechanisms for change – claiming for variations, delay costs, latent conditions and other unexpected events under a contract
  • Closing out a contract – how does SOP law wrap up?
  • Other remedies to recover payment – what options are there if you’re not paid 


Learning Outcomes:

Participants will develop an understanding of both the general legal issues surrounding complying with the law of payments, and also the impact on the business of day to day project actions. The latter will include the importance of cashflow, how reporting impacts that, and how project/ contract management activities impact cashflow on the business.
